Disclaimer & Risk Warning
Last updated: September 6, 2026
1. What This Document Covers
This disclaimer applies to all public SMC ChartSense surfaces:
- The website, smcchartsense.com, including all articles, guides, and published chart reads
- The SMC ChartSense practice app on Google Play (Android)
- The Telegram channel and any order flow reads or market commentary published there
- The YouTube channel (@SMCChartSense), Instagram, and other social accounts
- TradingView indicators published under the SMCChartSense account
- Products listed on Gumroad
Products with their own binding terms. Two products have separate legal terms that you accept before signing in. Those terms govern your use of those products, and this page does not replace them:
• Order Flow Lab — orderflow.smcchartsense.com, with its own in-app disclaimer and terms.
• Backtest Pro — app.smcchartsense.com, with its own disclaimer and legal terms at app.smcchartsense.com/legal.
2. Educational Purpose Only
Everything SMC ChartSense publishes is educational. Our apps are training simulators and pattern-recognition tools. Our articles, guides, videos, and chart reads explain how markets are read. None of it is financial advice, investment advice, or a recommendation to buy, sell, or hold anything.
We are not a trading platform, a broker, or a portfolio manager. We do not execute trades, hold client funds, or manage anyone’s money. We are not registered financial advisers in any jurisdiction.
3. Live Market Commentary and Chart Reads
We publish order flow reads and market commentary on live instruments — on our Telegram channel, on this website, and on social media. This section applies to all of it.
That commentary is general analysis and opinion only. It describes what has traded, who was transacting aggressively, and where activity concentrated, and it may set out competing interpretations of what that could mean next. It gives no entry prices, no exit prices, no stop levels, no targets, and no position sizing.
It is not tailored to your circumstances, your capital, your risk tolerance, or your objectives — we know none of these things. It must not be relied on as advice. Any trading decision you make, and every consequence of it, is entirely your own.
Where a chart read discusses a past period and states how a situation resolved, that is a record of what happened. It is not a claim about accuracy, a performance record, or an indication that any future read will resolve the same way. Where polls or discussion prompts appear alongside commentary, they are for discussion; a poll result is not a signal and carries no analytical weight.
4. Cryptocurrency and Virtual Digital Asset Risk
Crypto products and NFTs are unregulated and can be highly risky. There may be no regulatory recourse for any loss from such transactions.
Much of our content examines cryptocurrency perpetual futures. These are leveraged instruments. Leverage means small price movements have a proportionally larger effect on your capital, in both directions, and positions can be liquidated in full. Crypto markets trade continuously, move violently, and can gap through price levels without trading at them.
5. High Risk Warning
Trading financial markets — including Forex, Cryptocurrencies, Stocks, Commodities, and Derivatives — carries a high level of risk. You could lose some or all of your capital. Never trade with money you cannot afford to lose.
The majority of retail traders lose money. Nothing we publish changes that, and no amount of study removes the risk.
6. Order Flow Concepts (Delta, Footprint, Absorption, Volume Profile)
Delta, cumulative delta, footprint charts, absorption, exhaustion, and volume profile are ways of describing transactions that have already occurred. They are records, not forecasts. A high-volume node marks where business was done; it does not oblige price to return. A divergence describes a disagreement between price and aggressive flow; it does not indicate which will prevail.
These readings are interpretive. Two experienced readers can look at the same footprint and reach different conclusions, and both may be reasonable. Order flow data also varies by venue — the same instrument on a different exchange produces different figures.
7. SMC Concepts (Order Blocks, Fair Value Gaps, Break of Structure)
Order Blocks (OB), Fair Value Gaps (FVG), Break of Structure (BOS), Change of Character (CHoCH), and other Smart Money Concepts presented in our content are theoretical market interpretations, not proven trading signals. They are historical observations based on past price action and do NOT guarantee future price movement.
These concepts are subjective — different traders may interpret the same chart differently. Different brokers may show different price data, and what appears as an OB or FVG on one chart may not appear on another. They should never be used as the sole basis for trading decisions.
8. Candlestick and Chart Patterns
Candlestick patterns — including but not limited to Hammer, Doji, Engulfing, Morning Star, Evening Star, Three White Soldiers, Harami, Piercing Line, Shooting Star, Marubozu, Tweezer Top/Bottom, Inside Bar, Abandoned Baby — are historical observations, not predictive signals. A pattern appearing does NOT guarantee price will move in the expected direction. Patterns frequently fail in live markets.
Chart patterns — including but not limited to Head & Shoulders, Inverse Head & Shoulders, Double Bottom, Triple Top, Triple Bottom, Rising Wedge, Falling Wedge, Bullish Flag, Bearish Flag, Bearish Pennant, Symmetrical Triangle — are likewise historical observations. Pattern recognition is inherently subjective; two experienced traders may identify different patterns on the same chart, and breakouts frequently fail.
9. Pattern Detection Criteria
Pattern detection criteria used in our apps and indicators — for candlestick patterns, chart patterns, SMC concepts, and order flow alike — are based on commonly accepted definitions from technical analysis literature. These criteria may differ from those used by other sources, platforms, educational providers, or individual traders. Our identification of any pattern is not the definitive or only correct interpretation.
10. TradingView Indicators
Indicators published under the SMCChartSense TradingView account are visualisation tools. They mark and annotate structural events in price data that has already printed. They do not generate signals, do not predict price, and make no performance claims. Access is governed by TradingView’s own terms in addition to this disclaimer.
11. No Guarantee of Performance
Success in any SMC ChartSense simulator, or high scores on training exercises, does not guarantee success in live trading. Real trading involves psychological pressure, slippage, spread costs, funding costs, commissions, volatility, and liquidity risk that no simulation reproduces.
Past performance shown on any chart or in any content does not indicate or guarantee future results. We publish no track record, no win rate, and no profit figures, and any such claim made in our name elsewhere is not ours.
12. Regulatory Status
SMC ChartSense and its creators are NOT registered with SEBI (Securities and Exchange Board of India) as Research Analysts or Investment Advisers under the SEBI (Research Analysts) Regulations, 2014 or the SEBI (Investment Advisers) Regulations, 2013, and are not registered as advisers with any regulator in any other jurisdiction.
Virtual digital assets are not securities under Indian law and fall outside SEBI’s securities framework. We state our registration status plainly so there is no ambiguity about what we are: an educational publisher, not an advisory service.
13. Impersonation and Official Channels
Our official channels are listed at smcchartsense.com/start. Accounts, channels, or groups using our name or logo that are not listed there are not operated by us, and we are not responsible for anything they publish. We never send trading signals, never solicit funds, and never ask anyone to send money to an individual. If an account claiming to be us does any of these things, it is not us.
14. No Liability
SMC ChartSense, its developers, content creators, affiliates, and associated parties shall not be held liable for any losses, damages, or financial harm resulting from the use of our apps, website, published commentary, videos, or any associated materials. All trading decisions are made solely at your own risk.
15. Third-Party Data
Market data used in our apps, videos, articles, and chart reads is sourced from public APIs (such as Binance) and is provided “as-is” without warranty of accuracy or completeness. Price and order flow data may contain gaps, delays, or errors, and figures may be restated by the venue. It should not be relied upon for live trading decisions.
16. Advertising, Links, and Material Connections
To keep the practice app free, the Android app displays occasional full-screen (interstitial) advertisements served by Google AdMob, shown at natural breakpoints between charts and practice questions — never during active content. We do not endorse, control, or vet the specific ads shown. See our Privacy Policy for how advertising data is handled.
Where any link we publish earns us a commission or where we have any other material connection to a third party, we disclose it at the point of the link. We do not accept payment to promote products without disclosure.
17. Age Requirement
Our apps and content are intended for users aged 18 and above. Users below the legal trading age in their jurisdiction should not use our content for the purpose of real-money trading.
18. Intellectual Property & Copyright
All SMC ChartSense content — including but not limited to app code, chart generation algorithms, pattern detection logic, scoring systems, indicator source code, baked chart data, UI design, educational text, long-form articles, tape reads, analytical commentary, annotated chart images, original market analysis and pedagogical narratives, graphics, branding, videos, and website content — is the intellectual property of SMC ChartSense and its creators, protected under applicable copyright laws.
You may NOT:
- Copy, reproduce, distribute, or republish any of our content, including chart reads and annotated charts.
